Representation in “To kill a mockingbird” Essay

Mockingbird: The mockingbird represents innocence. Like hunters who kill mockingbirds for sport, people kill innocence, or other people who are innocent, without thinking about what they are doing. Atticus stands firm in his defense of innocence and urges his children not to shoot mockingbirds both literally and figuratively. The mockingbird motif arises four times during To Kill a Mockingbird. First, when Atticus gives Jem and Scout air guns for Christmas and instructs them not to kill mockingbirds. Second, when B.B. Underwood writes about Tom Robinson’s death in his column. Third, a mockingbird sings right before Bob Ewell attacks Jem and Scout. Finally, Scout agrees with Atticus that prosecuting Boo for Ewell’s murder would be like killing a mockingbird. Atticus: Father of Jem and Scout, Atticus Finch sits on the Alabama State Legislature and acts as Maycomb’s leading attorney. The epitome of moral character, Atticus teaches his children and his community how to stand up for one’s beliefs in the face of prejudice and ignorance by defending a black man, Tom Robinson, wrongfully accused of raping a white woman. Having lost his wife when Scout was two years old, Atticus devotes himself to his children despite criticism from family and neighbors who think his children lack discipline and proper guidance. Atticus stands as one of literature’s strongest and most positive father figures. As one of the most prominent citizens in Maycomb during the Great Depression, Atticus is relatively well off in a time of widespread poverty. Because of his penetrating intelligence, calm wisdom, and exemplary behavior, Atticus is respected by everyone, including the very poor. He functions as the moral backbone of Maycomb, a person to whom others turn in times of doubt and trouble. But the conscience that makes him so admirable ultimately causes his falling out with the people of Maycomb. Unable to abide the town’s comfortable ingrained racial prejudice, he agrees to defend Tom Robinson, a black man. Atticus’s action makes him the object of scorn in Maycomb, but he is simply too impressive a figure to be scorned for long. After the trial, he seems destined to be held in the same high regard as before. Atticus practices the ethic of sympathy and understanding that he preaches to Scout and Jem and never holds a grudge against the people of Maycomb. Despite their callous indifference to racial inequality, Atticus sees much to admire in them. He  recognizes that people have both good and bad qualities, and he is determined to admire the good while understanding and forgiving the bad. Atticus passes this great moral lesson on to Scout—this perspective protects the innocent from being destroyed by contact with evil. Ironically, though Atticus is a heroic figure in the novel and a respected man in Maycomb, neither Jem nor Scout consciously idolizes him at the beginning of the novel. Both are embarrassed that he is older than other fathers and that he doesn’t hunt or fish. But Atticus’s wise parenting, which he sums up in Chapter 30 by saying, â€Å"Before Jem looks at anyone else he looks at me, and I’ve tried to live so I can look squarely back at him,† ultimately wins their respect. By the end of the novel, Jem, in particular, is fiercely devoted to Atticus (Scout, still a little girl, loves him uncritically). Though his children’s attitude toward him evolves, Atticus is characte rized throughout the book by his absolute consistency. He stands rigidly committed to justice and thoughtfully willing to view matters from the perspectives of others. He does not develop in the novel but retains these qualities in equal measure, making him the novel’s moral guide and voice of conscience. atticus’s wisdom, Scout learns that though humanity has a great capacity for evil, it also has a great capacity for good, and that the evil can often be mitigated if one approaches others with an outlook of sympathy and understanding. Atticus Finch – Scout and Jem’s father, a lawyer in Maycomb descended from an old local family. A widower with a dry sense of humor, Atticus has instilled in his children his strong sense of morality and justice. He is one of the few residents of Maycomb committed to racial equality. When he agrees to defend Tom Robinson, a black man charged with raping a white woman, he exposes himself and his family to the anger of the white community. With his strongly held convictions, wisdom, and empathy, Atticus functions as the novel’s moral backbone. The father of Scout and Jem, Atticus is a lawyer and an extremely morally upright man who strives to deal with everyone fairly. Atticus is sometimes overly optimistic, but his unshakable hope in mankind and self-created role as the town ‘do-gooder’ sustain him. Atticus’ wife died when Scout was very small, and he has raised his children only with the assistance of Calpurnia, his black housekeeper and cook. Quotation: I remember when my daddy gave me that gun. He told me that I should never point it at anything in the house; and that he’d rather I’d shoot at tin cans in the backyard. But he said that sooner or later he supposed the temptation to go after birds would be too much, and that I could shoot all the blue jays I wanted – if I could hit ’em; but to remember it was a sin to kill a mockingbird. Well, I reckon because mockingbirds don’t do anything but make music for us to enjoy. They don’t eat people’s gardens, don’t nest in the corncrib, they don’t do one thing but just sing their hearts out for us. Atticus’s advice to Scout deals with his philosophy about tolerance, and how if you try and put yourself in another person’s place, one might better understand their reasoning. The title of To Kill a Mockingbird has very little literal connection to the plot, but it carries a great deal of symbolic weight in the book. In this story of innocents destroyed by evil, the â€Å"mockingbird† comes to represent the idea of innocence. Thus, to kill a mockingbird is to destroy innocence. Throughout the book, a number of characters (Jem, Tom Robinson, Dill, Boo Radley, Mr. Raymond) can be identified as mockingbirds—innocents who have been injured or destroyed through contact with evil. This connection between the novel’s title and its main theme is made explicit several times in the novel: after Tom Robinson is shot, Mr. Underwood compares his death to â€Å"the senseless slaughter of songbirds,† and at the end of the book Scout thinks that hurting Boo Radley would be like â€Å"shootin’ a mockingbird.† Most important, Miss Maudie explains to Scout: â€Å"Mockingbirds don’t do one thing but . . . sing their hearts out for us. That’s why it’s a sin to kill a mockingbird.† That Jem and Scout’s last name is Finch (another type of small bird) indicates that they are particularly vulnerable in the racist world of Maycomb, which often treats the fragile innocence of childhood harshly. His stern but fair attitude toward Jem and Scout reaches into the courtroom as well. He politely proves that Bob Ewell is a liar; he respectfully questions Mayella about her role in Tom’s crisis. One of the things that his longtime friend Miss Maudie admires about him is that â€Å"‘Atticus Finch is the same in his house as he is on the public streets.'† The only time he seriously lectures his children is on the evils of taking advantage of those less fortunate or less educated, a  philosophy he carries into the animal world by his refusal to hunt. And although most of the town readily pins the label â€Å"trash† on other people, Atticus reserves that distinction for those people who unfairly exploit others. Atticus believes in justice and the justice system. He doesn’t like criminal law, yet he accepts the appointment to Tom Robinson’s case. He knows before he begins that he’s going to lose this case, but that doesn’t stop him from giving Tom the strongest defense he possibly can. And, importantly, Atticus doesn’t put so much effort into Tom’s case because he’s an African American, but because he is innocent. Atticus feels that the justice system should be color blind, and he defends Tom as an innocent man, not a man of color. Our first-person narrator is Scout Finch, who is five when the story begins and eight when it ends. From the first chapter, though, it’s clear that Scout is remembering and narrating these events much later – after all, the second paragraph of the novel begins, â€Å"When enough years had gone by to enable us to look back on them, we sometimes discussed the events leading to [Jem’s] accidentâ⠂¬  (1.2). For the most part, Scout recounts the events from her childhood perspective, as she understood them at the time, rather than imposing an adult commentary. This makes the narrative perspective a naà ¯ve one: often we get descriptions of events just as she experiences them, without commentary on what they mean, or a commentary that is humorously innocent. But having the adult perspective be there in the background, even if it isn’t in play for most of the narration, means it can pop out when it’s needed to point out important things that the narrator realizes only later, to make sure that the reader sees them too. The strongest element of style is Lee’s talent for narration, called â€Å"tactile brilliance†. â€Å"Harper Lee has a remarkable gift of story-telling. Her art is visual, and with cinematographic fluidity and subtlety we see a scene melting into another scene without jolts of transition. Lee combines the narrator’s voice of a child observing her surroundings with a grown woman’s reflecting on her childhood, using the ambiguity of this voice combined with  the narrative technique of flashback to play intricately with perspectives. This narrative method allows Lee to tell a â€Å"delightfully deceptive† story that mixes the simplicity of childhood observation with adult situations complicated by hidden motivations and unquestioned tradition. However, at times the blending causes reviewers to question Scout’s preternatural vocabulary and depth of understanding. Lee uses parody, satire, and irony effectively by using a child’s perspective. After Dill promises to marry her, then spends too much time with Jem, Scout reasons the best way to get him to pay attention to her is to beat him up, which she does several times. Scout’s first day in school is a satirical treatment of education; her teacher says she must undo the damage Atticus has wrought in teaching her to read and write, and forbids Atticus from teaching her further. Lee treats the most unfunny situations with irony, however, as Jem and Scout try to understand how Maycomb embraces racism and still tries sincerely to remain a decent society. Satire and irony are used to such an extent. Scout narrates the story herself, looking back in retrospect an unspecified number of years after the events of the novel take place. POINT OF VIEW  · Scout narrates in the first person, telling what she saw and heard at the time and augmenting this narration with thoughts and assessments of her experiences in retrospect. Although she is by no means an omniscient narrator, she has matured considerably over the intervening years and often implicitly and humorously comments on the naà ¯vetà © she displayed in her thoughts and actions as a young girl. Scout mostly tells of her own thoughts but also devotes considerable time to recounting and analyzing Jem’s thoughts and actions. TONE  · Childlike, humorous, nostalgic, innocent; as the novel progresses, increasingly dark, foreboding, and critical of society MAJOR CONFLICT  · The childhood innocence with which Scout and Jem begin the novel is threatened by numerous incidents that expose the evil side of human nature, most notably the guilty verdict in Tom Robinson’s trial and the vengefulness of Bob Ewell. As the novel progresses, Scout and Jem struggle to maintain faith in the human capacity for good in light of these recurring instances of human evil. RISING ACTION  · Scout, Jem, and Dill become fascinated with their mysterious neighbor Boo Radley and have an escalating series of encounters with him. Meanwhile, Atticus is assigned to defend a black man, Tom Robinson against the spurious rape charges Bob Ewell has brought against him. Watching the trial, Scout, and especially Jem, cannot understand how a jury could possibly convict Tom Robinson based on the Ewells’ clearly fabricated story. CLIMAX  · Despite Atticus’s capable and impassioned defense, the jury finds Tom Robinson guilty. The verdict forces Scout and Jem to confront the fact that the morals Atticus has taught them cannot always be reconciled with the reality of the world and the evils of human nature. FALLING ACTION  · When word spreads that Tom Robinson has been shot while trying to escape from prison, Jem struggles to come to terms with the injustice of the trial and of Tom Robinson’s fate. After making a variety of threats against Atticus and others connected with the trial, Bob Ewell assaults Scout and Jem as they walk home one night, but Boo Radley saves the children and fatally stabs Ewell. The sheriff, knowing that Boo, like Tom Robinson, would be misunderstood and likely convicted in a trial, protects Boo by saying that Ewell tripped and fell on his own knife. After sitting and talking with Scout briefly, Boo retreats into his house, and Scout never sees him again.

Wobbling Pivot

The Wobbling pivot was that there was two men fighting over a bicycle and there were people listening to them in Attainment Square. There was a riot that had happened in China where there was a riot that happened and there were a lot of people protesting for domestic tranquility in Beijing. In the streets of Changing there were people in taxis and most of them that took a ride was businessman and foreigners because the fares prices were very high. There were policeman that were extremely violent or didn't care about their actions about how hey treated people in certain cities and china as a whole was corrupted.For example when some girl had been raped and killed there was no Justice against that and the family pleaded for a trial and they got it but it took a while. Another example is when the girl had got murdered and was raped and she died and the young girl funeral was held but officials said that killing is not a crime. Also there were people trying to fight for their individual rights like people had anger over the unsafe mines and the polluted water that was not safe to drink. There were unsafe working intuitions and endless demands of local officials for bribes and sex privileges.There had been a problem with the farming with the water supplies poisoned and their crops being ruined and there could be rising Incidences of cancer and that was a panic. There were peoples homes destroyed for no apparent reason and If they resisted thousands were fined and even going to Jail some of the time. The main two things that the officials wanted were money and power which they only got If from family or any kind of racial connections. There were many cities that were under attack in China and the people still protested and many were killed and very few police officers.If you broke any laws In China you may have been sentenced to death regarding these protests. There were other things Like Education, public safety; food security and culture were nit high state spendin g priorities but they focused more on passing examinations which meant you were a certain elite status. This meant that Americans on the home-front had to be rationed for what they can have, which meant they can only purchase so much of certain items. Many consumer goods had to be severely rationed or taken out of the market totally, because they were needed for the war effort. This is why Americans were encouraged to grow â€Å"Victory Gardens† so that they produced their own food, and what food they normally consumed from markets could help contribute to our troops as well as those of the Allied forces. Food production was then focused on providing for the troops instead of the everyday consumer, because they were expected to contribute for themselves and thus help contribute to the soldiers. The United States also made many technological innovations that helped revolutionize certain aspects of war, one of these being the pressurized air cabin in air planes. This helped prevent pilots from getting hypoxia (low oxygen levels in the blood), while also letting planes fly higher, and with more comfort for its passengers. This meant allied bombers like the b-29 could fly higher and escape low anti air missiles and fire from the ground. The Manhattan Project that the U.S. held with the United Kingdom and Canada also helped produce many technological innovations. The main product of this research program was the atomic bomb that would eventually be ordered into use on Japan, and would usher in their surrender and the end of the Second World War. We all know now that Goering’s statement was terribly misinformed, otherwise Germany and the Axis Powers would not have been defeated by the Allies. The United States was the team Captain in this effort and without them the chances of winning would have been slim to none. In the case of this war, and in the case of any war, production plays a key role, and in World War Two, the United States â€Å"Arsenal of Democracy† provided the Allies with the goods and resources necessary for victory.

Contribution of Women to the Economy in the Middle Ages Introduction This dissertation will focus on the contribution of women to the economy in the Middle Ages. It will explore how and to what extent women contributed to the economy of Medieval England, asking the question of ‘Is the role of women in the medieval economy undervalued by history?. As part of this it will explore to what extent women are adequately reflected in the contemporary sources, and if they are not adequately reflected, aim to explain the reasons for this. It is also interesting to see if the contributions made by women vary depending on their social status and whether they reside in the urban or the rural environment. It is important to explore and aim to discover whether the contribution women made to the economy changed over time, whether it is to an increased contribution or a decreased one due to certain events or social changes. Clearly the role of men in society in the middle ages will be of great significance due to their large influence on the lives of women. In order to fully understand and appreciate the contribution which women made to the economy in the Middle Ages it is important to look at how they worked alone, but also how women were recognised and treated alongside men, especially those who were engaged in a similar occupation. The role of women alongside their husband is also of great importance. Historians such as Christopher Brooke have often argued that women cannot be studied without also studying the men of the period. It is also advantageous to compare a womans work in the town to the work which women in the countryside were engaged in. Perhaps an aspect within this which could be explored is whether or not the work which women participated in changed over time, particularly after the Black Death. To look at all of the above, individual places will be looked at, for example the city of London and the town of Wakefield, but also individual people, especially those who appear in the court rolls on numerous occasions. It is d ifficult however to look at working class women in much detail as their lives were not as well documented as a woman of a higher social class and status. Also, the majority of sources used have been written by and for men. Typically, when looking at the middle ages, the work of women can be overlooked as it is often assumed that they simply worked in the home. Although this is not strictly true, it is important to look at the work which women undertook in the home and whether or not and to what extent this work impacted on any other work which they might have been undertaking. It is sometimes difficult to assess the work which women did as very few women in the middle ages were literate, and therefore when they do appear in records it is nearly always from a male perspective, in records written for males. This creates a certain difficulty in truly understanding what women participated in, as it is often assumed that they simply worked in the house and there are no sources which concentrate purely on work undertaken in the household. Along with this, men often appeared in place of women in court rolls. This was often due to the fact that a man would pay the fine for a woman who had done wrong, for examp le brewing outside of the assize given by the manor. However, there are also a large number of instances where women do appear alongside men at court. It is important to recognise here however that women could often be found undertaking jobs inside their homes, for example textile work. This will also be considered. Chapter one of this dissertation will mainly focus on women and the household. It will look in detail at the role which women played in the household. It will explore their role as both a wife and a mother but also their eventual role as a widow. Sources are scarce for this aspect of life in the Middle Ages but ones which do provide a useful insight include court rolls where women asked permission to marry. A main issue here is the amount of sources which are available to utilise for this aspect of a womans life. With few sources available it is understandably difficult to distinguish whether these women recorded in the sources are typical of society or anomalies. Chapter two will look at womens work in the home. As part of this the textile industry will be looked at, as well as the roles of women in domestic service and agricultural activity and markets. Within this there are various primary sources which can be utilised. These include court rolls, coroners rolls and weavers ordinances. There are of course various limitations to each of the sources. Perhaps the main one to consider here is that sources were generally written by males and for males. As well as this there are limited mentions of women in domestic service, although they are not as limited as the sources on women in the home in general. Chapter three evaluates womens work outside of the home. It looks at the occupation of brewing and uses sources such as coroners rolls and court rolls to look at the extent to which women could be found in this profession. It also explores prostitution as a lesser thought of economic contribution. Together it seeks to discover the contribution of women to the medieval economy whilst asking whether or not the women are adequately reflected in the sources, and whether as a result of this, these women have been undervalued by history. Women And The Household It is arguable how much of a womans life was spent in the household looking after the family unit. It is typically thought that a large amount of a womans time was spent in the home and although this is supported to an extent by the majority of sources, there are also a significant number which dispute it. A large number of historians, such as Christopher Dyer, Jennifer Ward and Joanne Bennett have looked at the everyday lives of women and various conclusions have been drawn from their studies. It is important to look at the conclusions of both historians who argue that women spent the majority of their time in the home, and those who argue that women, like men, were able to hold an occupation, as well as working for the family. As well as this, some historians have argued that there was a difference in the way in which women contributed to the household depending on their social class. All of these factors are important when looking at the work women did, as any work undertaken in t heir household would have had an impact on the amount of paid work which they were able to undertake. It is worth noting that if a woman did not undertake paid work and worked only in the household, it is not likely to have been recorded and so makes it difficult to find information on these women. The role of a woman as both a wife and mother in the household is an important one. Women were initially regarded as the property of men and this is reflected by a large number of women asking for permission to marry at the manor courts. An example of this is the court roll of 27 February 1360 from the manor of Walsham le Willows where Agnes Jay ‘pays 4s fine for leave to marry Robert Lene. Being married meant that a woman had a greater right to security and property than she would have had as a single woman as she sometimes gained joint tenancy with her husband. This joint tenancy over their house and belongings can be seen in court rolls, for example in the court of 16 August 1369. At this court ‘William de Preston†¦and Alice his wife†¦sold to William Kent†¦certain utensils in a house which he held from them. The fact that Alice and William together agreed to sell items in a house which they jointly owned shows that Alice had rights to property, which she may not have had if she were single. However, these rights changed once more when a woman was widowed. Every woman who had been married to a freeman of the city became a freewoman of the city on his death. Whilst this is a good thing for women, it carried the condition that she only retained this status as long as she stayed single. Whilst living with their husband women were expected to learn about his work in order for them to cover whilst their husband was away but also so that they could continue his business on his death. There are numerous cases in sources of women taking over the business of their husbands and in some instances continuing to train any apprentices their husband may have had. This can be used to show that women were not as restricted as they are often assumed to be. Widows seem to appear much more frequently in sources than married or single women. This is most likely to be due to the fact that they do no have a male to answer for them or to represent them. Males are frequently seen in documents and it is often argued that they took fines on behalf of their wives. This is mainly because a man was commonly seen as in charge of his wife and the family and therefore he was held responsible for anything which they did. Also, widows are commonly seen in court rolls seeking money or property owed to them, something which their husband would previously have done. This can be illustrated with the case of Alice de Perers of the city of London who sued Richard de Kent for 200 marks which she had lent him and not been returned. We can assume that Alice was a widow as she was representing herself in the court and was not presented as a ‘wife of someone else. However, whilst it is commonly thought that men were in control of their household, there are some who argue that they were in fact not in control at all. Historians such as Ward argue that the household was a place which women ruled. She argues that the running of the household and the care of the family within it took up a large amount of a womans time and that as well as this a woman should also be able to help her husband with his job. Historians such as Dyer however, argue that while a woman in the aristocracy would have been the effective head of household, the household itself was predominantly masculine. This can be illustrated by the amount of males employed within the upper class household, for example servants and officers. In comparison there were relatively few female employees. Dyer observes that a peasant woman was expected to manage her household, but that she could also choose to have her own employment as long as it was secondary to any household chores she was expe cted to complete. It can be construed that though men were perceived to be the head of the household it was in fact the women who were responsible for everything within it. It is important to realise that being a wife and a mother was often just part of the work which women were expected to undertake. In some cases they were also able to hold their own employment, as well as helping their husbands with their businesses. Therefore we can see that women could hold jobs both inside and outside of the home, both of which are important when looking at the contribution of women to the economy and whether or not their role has been undervalued by history. Work In The Home i. Textiles J. Ward has argued that when women were not engaged in work in the home they were able to hold occupations for which they were paid. She argues that whilst a woman was free to do this, not all did and the majority of those that were employed worked in industries similar to work which they would have been doing in the home. An industry which employed a large number of women was the textile industry. Women were able to spin, weave and embroider from their own home if they chose to, which enabled them to continue with their household duties. Also, the majority of women were unable to be engaged in any occupation significantly different to their duties in the home as they only received a very basic education, as well as having to fully utilise the skills which they had been taught by their mothers. There were of course exceptions to the above and they will be considered in turn. The textile industry was one which is evident in both the town and the countryside, though more predominantly in the countryside and smaller towns after the thirteenth century. Textile work was more notable in homes in the countryside but it was not unusual for a woman to move to the town and take her work with her. This is significant as historians such as Dyer have suggested that it was much harder to come across skilled textile work in the towns unless the woman in question was skilled and had the money required for all the necessary equipment. An interesting point to make here is that whilst men were limited to being able to participate in one industry, women could participate in two or three if she chose. It is therefore not uncommon to find women working as spinners and weavers for example. Ward continues her argument by suggesting that women were engaged in the textile trade purely to provide clothes for her family. This can be supported with Anthony Fitzherberts The Boke of Husbandry. Written in 1523 Fitzherbert outlines basic tasks expected of a wife in her home, but also within her work in and around the home. He outlines in great detail the importance of the textile industry and how a husband should have sheep of his own but ‘let his wife have part of the wool to make her husband and herself some clothes. This illustrates the argument that women were engaged in the textile industry purely to provide clothes for their families. However, other sources provide a different perspective. Women were referred to by their trade in court rolls if they were the head of the household, for example ‘Joan Spinster, ‘Agnes, servant of†¦. For them to be referred to as spinners as opposed to ‘his wife or ‘wife of, it can be assumed that they were engaging in a significantly larger amount of textile work than simply that required for their family. This of course would not have been the case for all women. Whilst textiles remained a main occupation of women until the late eighteenth century, it did have periods of decline within both the thirteenth century and the late mid to late fifteenth century. The decline in the market for textiles is illustrated by Weavers ordinances. Weavers ordinances show a declining market, as well as employment opportunities, as they were designed to go together with local monopolies on particular cloth. In some towns the monopoly stretched as far as to limiting each employer to one apprentice each. In the weavers ordinance of Shrewsbury from 1448 it describes how ‘no woman shall occupy the craft of weaving after the death of her husband except for one quarter of the year. This illustrates a distinct decline in the occupation, but can also be used to show that women were not as free to participate in an occupation as they maybe once seemed. It can also be used to suggest that widows were not as free as maybe once thought. As well as this it supports t he suggestion that women found it hard to move their craft from the countryside to the town unless they had significant amounts of money and they were highly skilled. It is possible that this was a minor cause in the decline in the textiles industry in the thirteenth century when cloth making originally took place for home and for export in larger towns but moved to taking place mainly in the countryside or smaller towns, with a distinct decline in exports. Despite this decline it has been estimated that in towns such as Babergh Hundred in Suffolk up to nineteen percent of the population was still employed within textiles, and this is not including the women who were part time spinners, who would have added a considerable amount to this. This illustrates how women were continuing to engage in textile work throughout the period. As mentioned previously, women were expected to fully understand the business of their husband so that they may take over in his absence or on his death. This is illustrated in the textile industry in the case of the will of John Walton, a weaver from York. He states that he leaves to ‘Margaret my wife my best woollen loom with those things to pertain it. This shows how women were able to take over the business from their husbands if necessary and therefore displays their capabilities. Wills such as these can also be used to show how women gained from their husbands only if they remained single. Women were able to retain freewoman status if their husband had been a freeman of the city, but only if they stayed single. The will of John Nonhouse, also from York, shows this to an extent. He states that ‘Isabel my wife has the said two looms with all he tools pertaining to them whilst sole. These two wills together show how women had the ability to continue work on their own a fter the death of their husband. They can however also be used to show how society had not fully accepted the majority of women who were working on their own. The absence of women from craft guilds can also be used to show the exclusion of women working on their own. The guild ordinances of York show us how ‘No woman of the said craft shall occupy the said craft after her husbands death longer than a whole year. This again illustrates the limitation of women on their own as opposed to those women who were married. It has often been argued by historians that it was the husband who gave the woman their social status and this supports the argument that single women were limited to crafts they could participate in. These factors together show how women were employed in the textiles industry throughout the Middle Ages. However, they also to an extent show how women were often employed and working as a result of their husband as while they may gain the equipment used in textiles after his death, they very rarely retained their position in the craft guild. This in turn made selling their products more difficult. Also, women participated in a larger amount of textile work than perhaps thought, although the sources to support this are fewer in number and within them it is difficult to find the women of the lower classes. ii. Agricultural Activity And Markets Throughout the Middle Ages farming was an important part of everyday life. The main priority when farming was not to produce for sale but to produce and provide for their own family, selling any excess they may have made. Women in the countryside and small sized towns were expected to help out on the land when they had completed their tasks in the home and the majority can be seen as capable of the agricultural tasks required of them. Farm work however did not produce a large amount of money as the majority of it was undertaken part time and the first objective was to feed the family. It is significant to note the way in which women contributed to agricultural work both before the Black Death and after it. This is due to the fact that the Black Death caused a great amount of changes to take place and this therefore impacted on women and their contribution. In the period before the Black Death it was common for members of peasant households to be called upon by the lord of the manor to carry out some agricultural work for him. Most peasants would carry out this work as they did receive payment for it, albeit a small one, but on some occasions it would not get done. This could be due to extensive amounts of work needing doing on their own land or in some case just choosing not to do it. Those individuals who did not work for the lord as required were called to court and fined. This can be seen in the manor of Walsham le Willows where ‘Christina Lene and Isabelle Spileman each amerced 3d. because they were summoned to winnow the lords corn†¦and did not come. This is significant as both of these being fined were women. Again it is possible to suggest that these women are either widows or are acting as head of their household while their husband is away. In either case it is a possibility that they did not winnow the lords corn a s they had too much work to complete in their own households or on their own land. A source which is of great importance when it comes to agricultural work is Walter of Henleys The Husbandry. Walter of Henley was an agricultural writer who wrote more than thirty sources on how to carry out agricultural procedures correctly. It also outlined what was expected of each person on the land. However, only ten of these sources give his name as the author and they have therefore caused much discussion amongst historians. The Husbandry was a highly read source. We know this due to the amount of copies of it which had been made, but also because of the amount of copies which have survived until today. Although it is thought that it was written around the 1250s it has caused much discussion amongst historians as to its original date. Despite this it remains a useful source for looking at agriculture in the Middle Ages. One part Walter of Henleys The Husbandry outlines the role of the dairymaid on the land. Women were mainly responsible for the poultry and the dairy of the land and so it can be argued that The Husbandry outlined their role in full as it would have the role of a man on the land. It states how ‘the dairymaid ought to look after all the small stock which are kept on the manor such as†¦geese†¦hens†¦chickens and eggs. It is arguable here that women were responsible for the livestock as the nurturing role required was similar to that they would have deployed in the home. These women who had been responsible for the dairy and poultry on the land were also often responsible for taking it to and selling it at the local market. Women of the manor could often be found selling cheese and poultry amongst other fresh produce. It is because of these trips to the local markets that we can see some of these women in coroners rolls. An example here is of Margaret Derbye of Bury, recorded in the Coroners rolls of Sussex in 1524. Margaret is recorded as ‘hurrying to Petworth market on horse and being thrown off of her horse. In the impact of landing on the groun d she injured her neck and died immediately. This case of a woman dying on her way to market shows how women were directly involved in the selling process. It also illustrates a womans contribution to not only maintaining the land but also making a profit from it. A further source of importance when looking at agriculture is Anthony Fitzherberts The Boke of Husbandry. As mentioned in chapter two, The Boke of Husbandry outlines basic expectations of a wife inside and outside of the home, amongst other things. Fitzherbert outlines how ‘it is a wifes occupation to winnow all kinds of grain, to make maltto make hay†¦ reap corn†¦and to go or ride to the market. This directly supports the point above where women can be seen in coroners rolls due to accidents on trips to local markets to sell their goods. The majority of the time it would be women from the countryside taking their goods into local towns to sell; however there would have been exceptions to this. This illustration of women from rural areas taking produce into the urban areas shows the difference between the rural and the urban. There were occasions where women can be seen to have been acting illegally when it came to markets and the buying and selling of goods. Agnes, wife to William Sandelere of Louth is an example of one of these women. She was called to the peace sessions of 1375 in Lincolnshire for being ‘a common forestaller of both salt and fresh fish at Louth. This can be used to argue that women would do things outside of their legal allowances to ensure that they made an extra income to support their family. Women can be seen in court rolls on numerous occasions both before and after the Black Death. In the manor of Ingoldmells women were often called to court for agricultural issues. One of these occasions is where Alan Polber complained that Agnes, the wife of Thomas Herward had stolen his crops. This illustrates that women were participating in agricultural work on the land, and can also be used to illustrate the notion that women did more agricultural work during the harvest. Another example here is of Beatrice Herward. She brings the issue to court that Alan Polber had beaten her and ‘struck her beasts. In this case Beatrice is found to be making a false claim. This not only shows that she was involved in agricultural work, but can also be used to suggest that she was a widow as she was the one to initiate the claim into the courts. The Black Death was a significant event in the middle ages, particularly for agriculture. From the time it first hit in 1347 until it eventually died out in 1351 the lives of both upper classes and lower classes were affected greatly. Perhaps a rather explicit change was the effect it had on the labour force in England. The Black Death caused more deaths in England than any previous famines had done. This meant that women could demand higher payment for goods and services as they were able to carry out more work, due to a lower number of people in the workforce. Before Black Death there had been a vast amount of people wanting work but this changed dramatically afterwards. Women were quick to fill in gaps in the workforce, carrying out a wide range of jobs. Goldberg refers to these women as a ‘reserve army. These women were able to demand a higher rate of pay than they had done previously due to the lack of labour. It is important to note however that women were the first to lo se out when the demand for labour returned to normal. It can therefore be seen that women were involved to quite a large extent in work on the land and in selling goods at local markets. Contemporary sources such as Walter of Henleys The Husbandry and Anthony Fitzherberts The Boke of Husbandry outline what was expected from a wife in regards to her work on the land. Court rolls help us to understand to an extent what women were doing in order to gain more of an income for her family. When looking at farming it appears that women added a great deal to this, especially during and in the short period after the Black Death. However, it is important not to forget that these women may have been small in number and also that as soon as labour supplies returned to their normal levels women were once again left out. iii. Domestic Service Throughout the Middle Ages a large section of urban society was made up of male and female servants. This number was significantly lower in rural areas due to the lower class status of the majority of the people who lived there. It is arguable that such a large proportion of women were engaged in domestic service because it was something which was almost identical to the work which they would have been doing in the home. Examples of female servants can be seen throughout the Middle Ages, along with the comparison of female servants to male servants. It is important to look at male as well as female servants here as they not only impacted on a womans home life but they also affected which jobs the women were able to be employed in. If there were a significant number of male servants it is arguable that not such a large number of female servants would be required. As well as this there were areas where male servants could be found employed and female servants not, for example elite hou seholds. This will be discussed later. Firstly, it is key to note that references made to female servants are not common. Ward has gone as far as to argue that it was more likely that a large number of women were slaves as opposed to servants. However, women servants can still be found in sources, even if it is to a lesser extent than their male counterparts. Arguably, female servants were less likely to be found in elite households than men. This could perhaps be pinned on the idea that male servants entered elite households to be apprenticed to a particular trade or skill, whereas women rarely entered for apprenticeships. This links back to the idea of women learning their key skills from their mothers in the home. A key point to make here is that women who were employed as servants were not always treated well. Although they were often given food and lodgings in return for their work, they still often received wages lower than male servants did. There were many cases of people being brought to court for mistreating their servants. John Catour of Reading, Berkshire went to court to complain against the way his daughter was being treated in her apprenticeship to Elis Mympe of London. It has been suggested that the apprenticeships of young girls to a trade or to be a servant were often periods of time much longer than necessary. This gives the impression that they may have been exploited as it can be argued that rather than spending all of the years learning the trade, they were in fact simply providing their master with cheap labour. A further example of servants being exploited can be seen when Margaret la Garnystere ‘brought action of trespass against Agnes, widow of Thomas Bagge†¦f or detaining their servant who was lent on March 23 to embroider until 13 April. In both of the above cases the courts reported that the females had been recovered. However, it is likely that a large proportion of these women would have been exploited for a considerable amount of time as the time of their apprenticeship may have been considered normal. It is however important to note that not all female servants would have been treated badly. There are numerous cases where servants were left goods in the wills of their masters. The three women serving Ellen Holgrate by her death in 1403 each received a cow as a thank you for helping her with her illness. This shows that whilst there were women who were being mistreated, there were also those who were valued in their occupation. It is also key to remember that whilst these women were working within a household they were gaining valuable skills which they could take back and utilise in their own homes. This is important when you consider that some servants were young, single women, but some servants were married women who lived apart from their families during service but eventually returned home. Therefore, whilst there were women engaged in domestic service it is difficult to tell exactly how many there were. There is evidence to suggest that women, both single and married, worked in the homes of others in order to gain an extra income for their family. There is also evidence to suggest that these women may have sometimes been mistreated, although this was not always the case and again, there is no suggestion as to how many women would have received poor treatment. All in all women did provide a good service as domestic servants, but it is important to remember that males also provided this service and women were consequently excluded from some aspects of it. Womens Work Outside Of The Home As we have seen previously, women could be found contributing to the economy in various ways from inside their homes. Women could often be found engaging in textile related activities as well as helping their husbands with any land they may have and selling produce at local markets. Women were expected to help their husbands in the running of their business so that they may take over in their absence or on their death. As well as this work women could also be seen participating in further occupations outside of household work and expectations. i. Brewing Brewing was an occupation which women could often be seen in. This was due to the fact that they could run their household as expected, but also take on a new type of work. At one stage women brewed the majority of the ale on sale in England. It is arguable that women were able to participate in brewing as ale was part of the staple diet in the Middle Ages and much of it was needed to sustain the population. Any ale a woman brewed was first provided to her family, and any surplus may have been sold after this. Surplus had to be sold soon after it was brewed as it took only a short period of time for ale to turn sour. It is because of the need for ale for everyday consumption that women who were brewing it were widespread across

Ambiguity in Coovers Quenby and Ola, Swede and Carl :: Quenby and Ola, Swede and Carl Essays

Ambiguity in Coover's Quenby and Ola, Swede and Carl    Ambiguity occurs often in writing, and readers often choose to fill in the blanks with facts, which are not from the text. By filling in spaces in the story, the reader creates a plot, which fits into their understanding. In Coover's "Quenby and Ola, Swede and Carl," the plot is ambiguous. Many of these ambiguities are subtle and are easily overlooked, leading the reader to make assumptions about the text. Simple words, phrases, or the language leads the reader to a plot, which almost fits the text. As a reader, I was not satisfied that there was no definitive plot in which I could understand the story. I read the story several times and came up with three different realities; none of them agreed completely with the text. My first conclusion of the story was that the story took place over the course of a week, and that all pieces of the story occurred. My second understanding was that the two sex scenes were both fantasies and that the other pieces took place over the cou rse of the week. Finally, the last conclusion I drew was that everything had happened, but during different years. Each of these plots, which I created out of the story's ambiguity, is invalid if you include all of the text and don't disregard some textual evidence and language. Thus the ambiguity causes the reader to fill in blanks and disregard textual discrepancies. By filling in the blanks and creating an understanding for themselves, the reader is destroying the text.    My understanding of the story after the initial reading was that all of the parts took place while Ola was fourteen. I fit the pieces in order of dinner (which leads to the living room), the story, the sex with Quenby, the sex with Ola, and Swede and Carl on a stagnant boat. In this plot, the story opens with all four people eating a bass dinner and then moving into the living room to sit in front of the empty fireplace. Macbeths tragic insanity Essay -- William Shakespeare

Insanity is defined as â€Å"[the] inability to understand the nature and consequences of one's acts or of events, matters, or proceedings in which one is involved.† In William Shakespeare’s Macbeth, the protagonist turned antagonist, Macbeth, was once â€Å"valour’s minion† (I.ii.16) a loyal and devoted nobleman of Scotland. However, he commits a heinous act of regicide in order to ascend the throne, only to become a tyrant who in the end was regarded as nothing but a â€Å"dead butcher† (V.ix.35). Macbeth was unarguably sane in the beginning of the play, however, at the end of the play its unclear whether or not Macbeth truly was a â€Å"deranged blood hound† (V.ii.32), or if he was still acting on his own accord. Critics may say that this â€Å"Bloody sceptered tyrant† (IV.iii.95), who murdered innocent people indiscriminately through the novel befell the holds of insanity, but in truth, Macbeth, whether for better or for worse, ne ver was truly driven insane. An attribute of insanity was previously defined as the inability to understand the consequences of one’s acts or events around one, which furthers the argument that Macbeth was sane. When Macbeth, due to his insecurity of his position as king starts eliminating his enemies, he does display a certain degree of incomprehension towards the consequences of his actions, saying â€Å"the very firstlings of my heart shall be/The firstlings of my hand† (IV.i.157-158). However, the very fact that he says he will not take into account what he thinks (such as the consequences of his actions), shows that he indeed does still have the ability to understand the consequences of his actions, hence he is not insane. Towards the end of the book is where Macbeth’s sanity is questioned most. One such question arises up... ... towards Macduff, this not only shows Macbeth’s guilt at having committed such a horrible crime towards Macduff, but also has an inkling of a conscience. From Macbeth’s comprehension of the events taking place around him to his repentance to his conscience, its unarguable that Macbeth at the end of the play was insane. From the beginning, Macbeth fabricates his own demise, eventually going on to control his fate right up till his ruinous end. Once a good, and loyal noble man of Scotland, Macbeth, was driven to by whatever motivation to commit acts of such malice, such cowardice and of such malevolence that it’s an insult to the memory of those whose lives were taken by him, to classify him as merely a ‘deranged hell hound’. 1. Law and the legal system are based on ideas from centuries past, but both are still constantly evolving to meet the needs of today’s world. What do you think will be the next amendment added to the US Constitution? Why? I think the next amendment will be the legalization of same sex marriage as it seems that more and more states are legalizing it. 2. The Constitution protects free speech, free press, free assembly, and freedom of religion. Additionally, the Supreme Court has upheld protection for freedom of expression. How has this culture of freedom led to the society we have today? It led us to be more controversial and voice our opinion more then other cultures around the world. In my opinion people are more caring and more likely to do acts of kindness in America then places like Russia. 3. What is an issue involving the legal system that is currently getting a lot of attention in your state? What is your opinion on the issue? An issue that is getting a lot of attention is the legalization of medical marijuana. I think it should be legalized as it shows signs of being a treatment for people who have cancer, AIDS, multiple sclerosis, pain, glaucoma, epilepsy, and other conditions. 4. Have your opinions on the legal system, the government, or law in general changed since you started taking this course? Why or why not? My opinion has not really changed, but I do understand a lot of it on a deeper level now.

Laws on Contagious Disease Quarantine Essay

There are two principal sources of current legal thinking on quarantine for contagious diseases. The first originates in the law of quarantine itself. The second concerns civil commitment. Quarantine laws are limited to controlling infectious diseases. Civil commitment laws govern incarceration when people are a danger to themselves or others, are mentally ill and unable to care for themselves, or present a danger to others because they spread infectious disease. Before antibiotics, quarantine was important in preventing the spread of infection. Since it was not possible to attack bacterial causes of disease directly, sources of disease had to be kept away from other people. According to a recent study in the Journal of the American Medical Association, many state statutes which address the control of contagious diseases have been on the books since the turn of the century. The leading case on quarantine, Jacobson v. Massachusetts was decided in 1905. Even more recent statutes were enacted forty years ago. Only ten states have substantially changed their TB-related law within the last few years. The public health powers in state statutes include: compulsory examination and treatment, emergency detention and quarantine. Quarantine may be defined as either in-home isolation or commitment to state facilities. These measures are accomplished through public health orders or court orders. Some states have civil and/or criminal penalties for failing to comply with a such an order. Other statutes do not spell out penalties. Some statutes define which diseases are contagious and therefore subject to quarantine regulations. Others authorize state health departments to decide which illnesses are contagious. Some empower public health authorities to make quarantine or isolation decisions without any direction as to illnesses or conditions. Thirty-three states permit authorities to isolate people in their homes. In most cases there are no due process protections specified out in the law. Forty-two states permit commitment to treatment facilities. Thirty-six states require a court order to commit someone to a facility. Several do not require a court order or a hearing. Generally court orders will be initiated by a petition from public health authorities requesting a hearing. Written notice to the person concerned is usually required, but the hearing may be held with or without the patient. Only thirteen states explicitly grant the right to be represented by counsel in any part of the proceedings. Of these, eleven will provide counsel to indigent individuals. Release is accomplished when a determination is made that the person is no longer a threat to the public health, or no longer infectious. Some statutes specify criteria for release which may be vague (â€Å"no longer a danger to the public health†) or specific (evidence in sputum tests that the person is no longer actively contagious). Ten states have no statutory time limits on the length of time a patient may be held without discharge or recommitment. In many states the only explicit due process protection afforded persons who are quarantined is the opportunity to petition the court for release. Quarantine is a very old public health measure. Historical references date back at least to the Old Testament. When people were thought (rightly or wrongly) to have a contagious condition, they were isolated from others by confining them to their houses or by compelling them to live outside the community. Following English common law United States quarantine laws fall under the power of the state to protect public health and safety. In Gibbons v. Ogden, the United States Supreme Court alluded to the legitimacy of quarantine under the police power. The Court directly reviewed quarantine concepts in Compagnie Francaise de Navigation a Vapeur v. Louisiana State Board of Health. The law and its implementation were upheld as an appropriate exercise of police power. The suit arose when a geographic area of Louisiana was closed off to all new entrants because of the presence of infectious disease. The plaintiffs (a shipping company) regarded the action as a Commerce Clause violation, because it interfered with foreign commerce. The Court rejected the Commerce Clause argument, holding that the law was not repugnant to the Constitution. The dissent urged that the Court should have been addressing the particular implementation of the law rather than its constitutionality in general. The dissenters agreed however that â€Å"[t]he power of the several States †¦ to establish quarantine regulations †¦ is so well settled by repeated decisions of this court as to be no longer open to doubt. Relevant statutory law is found under the power of counties to establish hospitals and under the powers of the department of health and the board of health. Some still-current sections were in place before 1953 when the General Code became the Revised Code. Quarantine measures under Ohio law included isolating people in their own homes as well as removing them to public facilities. In 194 9 the Attorney General considered whether â€Å"home quarantine†, authorized under  § 4429, General Code was an appropriate exercise of the police power. Medical authority at the time discouraged in-home care because it spread infection to others in the household and did not provide the most effective treatment. The Attorney General expressed concern about the â€Å"social and economic embarrassment† involved in placarding a home and isolating the whole family. Balancing the health benefit (or lack thereof, according to medical experts) against liberty interests and social stigma, he opined that â€Å"in view of control measures now available† home quarantine would be arbitrary and unreasonable under normal circumstances. Contemporary society thinks removing people from their homes to treat their illness may be inhumane. When this opinion was written, the opposite may have been true, at least for illnesses requiring long-term care. In 1951,  § 4429-1 of the Ohio General Code provided the department of health with the power to â€Å"at once †¦ cause [someone with a communicable disease] to be separated from susceptible persons in such places and under such circumstances as will prevent the †¦ conveyance of the infectious agents †¦ and shall enforce such restrictive measures as may be prescribed by the state department of health. Ohio law has several provisions which govern quarantine generally. Under  § 3701 of the Ohio Revised Code, the department of health has the authority to â€Å"declare and enforce† or â€Å"modify, relax and abolish† quarantines. It may make other rules for preventing communicable disease. The chapter also provides that individuals shall not kno wingly fail to prevent transmission of their illness to others. Those who care for sick individuals, and those who â€Å"have charge of a public conveyance or place of public accommodation† shall not recklessly or negligently fail to protect others; or fail to inform health authorities of the presence of contagion. Criminal penalties are available under quarantine law, but they do not appear to have been much used. The statutes and cases do express the obligations of infected persons and others to avoid the spread of infection. Ohio quarantine regulations are very sweeping in the power granted to boards of health. They are also sweeping in their potential effect on people’s lives. Most of the provisions below were effective when the code was revised in 1953, and were carried over from similar provisions in the General Code. Quarantine regulations are covered under  § 3707. Key provisions include the following:  § 3707. 6 – Physicians or other persons â€Å"called to attend† persons with contagious diseases are required to report to the health commissioner â€Å"the name, age, sex, and color [sic] of the patient. †  § 3707. 07 – In case of a complaint or reasonable belief that there is infectious disease at a particular place, the board of health shall ha ve it inspected, and may either send the sick person to a facility, or quarantine the location, including any people exposed to the disease.  § 3707. 08 – Where there is infectious disease, the board shall isolate infected persons and those exposed, and have the location placarded. Anyone isolated or quarantined must have written permission to leave locations to which they are restricted.  § 3707. 14 – When people are quarantined the board of health is obligated to provide food, fuel and other necessities, at public expense if necessary.  § 3707. 16, . 20 – Quarantined persons may not attend school, places of worship or other public gatherings. They may not be sent to any institution such as a jail, children’s home, or institution for the blind or mentally ill without notice of their illness or exposure. Significant changes were made in 1955, with the passage of Amended House Bill 127, â€Å"‘[t]he Recalcitrant Tuberculosis Law’ enacted to protect society and based upon the legal principle that liberty implies absence from arbitrary restraint, not immunity from reasonable regulations imposed in the interest of society†. This legislation was considered to be a significant advance, â€Å"protective rather than punitive. † It put in place the specific mechanisms for implementing  § 339. 40, infra, evidentiary requirements, and mechanisms for release. There is no mention of the right to counsel, however. Key provisions of Chapter 339 include the following:  § 339. 40 – when proper presentation of facts has been made, the board of health is authorized to order the removal of persons with TB who are a menace to public health and cannot be treated at home. If someone is suspected of having TB on the basis of medical evidence, that person may be compelled to be examined regularly until certified as â€Å"free from tuberculosis in a communicable stage. †  § 339. 51 – evidence of communicable TB consists of laboratory reports of sputum or other body fluid which are ositive for the presence of TB bacilli, or chest X-rays which show active TB. A sputum test showing bacteria means the person is considered to have active TB for three months or until three successive tests show no bacilli.  § 339. 52-. 60 a board of health may request an order from the probate court to remove someone to a tuberculosis facility. The board must file an application with the court allegin g that the person is suffering from TB, is a menace to public health, and has either â€Å"refused to enter or has absented himself from a tuberculosis hospital against medical advice. After an application has been filed, a hearing is scheduled. The person named in the application must receive a summons no less than three days before the hearing. The judge examines any witness from the board of health and any others. The hearing may be conducted without the person summoned, if he or she does not appear. If the judge determines the allegations of the application are true, â€Å"the †¦ court shall enter a commitment order committing the person to a facility. † When someone is committed, she or he remains hospitalized until discharged. After ninety days a patient may apply to the same probate court to be discharged. The discharge is requested on the grounds that the patient no longer has communicable TB, and thus is not a menace to public health. The court holds a hearing within seven days. If it determines that the patient is not infectious, the discharge will be ordered, but not otherwise. Patients may also be released when an appropriate public health official certifies they are no longer a menace to the community. Relevant Ohio case law deals with the powers of the board of health to make and enforce regulations. Cases of actual quarantine involved smallpox or venereal disease (VD) rather than tuberculosis. An early important case was Ex parte Company. Company concerned requests for habeas corpus filed by two women who had been arrested for prostitution. Neither was convicted. One was discharged by the court and the other was found not guilty. While they were in custody they had been found to have VD. When their cases were resolved they were quarantined for the disease and applied for habeas corpus to be released from quarantine. They asserted that the quarantine, examination and detention provisions of the Sanitary Code violated the Fourteenth Amendment of the U. S. Constitution and section 5. Article 1 of the Ohio Constitution; that the provisions violated Ohio law; and that the legislature was not permitted to delegate its power to make laws to other bodies. The court readily disposed of the Constitutional claims on the grounds that legislative power to enact â€Å"reasonable and proper restraints† for the public good â€Å"is no longer open to question†. It noted that the Fourteenth Amendment did not extend the Bill of Rights to the States. The statute provided that anyone charged with a prostitution offense should be held if they were found to be infected with a venereal disease. The court found that the law was adequately supported by another statute which provided for the quarantine of any persons infected with venereal disease, incarcerated or not. Lastly the court determined that the legislature had given administrative authority to boards of health to create rules and regulations. Such grants of authority had been upheld in a number of other states. Only one case with distinguishable facts held otherwise. The court dismissed the petitions and remanded the petitioners to the health commissioner. Thus in Ohio as in the rest of the country the legislature has the power to create boards of health, which themselves have the power to create and execute a wide variety of public health regulations. What distinguishes Ohio law in this area is the fact that it has not been modernized.

In Portuguese, R at the beginning of words, at the end of words, or before a consonant is pronounced like H. Many Brazilian students carry this habit into English words, pronouncing â€Å"restaurant† as â€Å"hestaurant† and â€Å"far† as â€Å"fah.† It’s especially common when the English word and the Portuguese word are similar, such as in â€Å"restaurant† and â€Å"regular.† SOLUTION: First, I have my students work on pronouncing the English R sound by itself. I demonstrate the correct mouth position and they imitate me. Then, we work on each word while exaggerating the R sound – so we say rrrrememberrrr, for example. Finally, we practice making that exaggerated R sound shorter and shorter until the student gets used to saying remember with an English R. It feels a little ridiculous, but it works! PROBLEM: Similar words Fortunately, Portuguese and English have a lot of true cognates – words that are similar in both languages, such as area, animal, culture, famous, music, romantic, hamburger, and sports. This makes it easier to remember the vocabulary – but more difficult to remember to pronounce the words â€Å"the English way.† SOLUTION: To show the difference in the sounds, I make comparisons with words that they already know and pronounce well in English – â€Å"The ‘a’ in animal is like the ‘a’ in and,† for example. I also draw attention to syllable stress – popular in English vs. popular in Portuguese. PROBLEM: Final consonants Portuguese doesn’t have letters like D, T, G, P, and K at the end of words, so it’s common for Brazilian students to accidentally add a little vowel sound at the end of English words – so big sounds like bigg-ee and stop becomes stopp-ee. One of the most famous is difficult turning into difficulty – which is also an English word, but the first is an adjective and the second is a noun. SOLUTION: I start with words ending in P because they’re the easiest to practice – we practice saying â€Å"stop,† â€Å"help,† and others, and I tell them to keep their lips together for a second at the end, then â€Å"release† them without making an extra sound. Then we move on to â€Å"rock,† â€Å"get,† â€Å"thing,† â€Å"good,† and so on, again, â€Å"holding† the final consonant for a moment before â€Å"releasing† it soundlessly.

Basically this means that the moral and ethical value of a person’s action should be judged by the consequence of that action. Utilitarianism is believed to be the most important of the three ethical theories because it has helped shape our world’s politics, economics, and public policy. This ethical theory explains to us that we can determine the ethical significance by judging the consequence of that act.So basically I understand utilitarianism as; what is good for the majority is just and that happiness is the ultimate goal. An example of my own would be; the utilitarian would say that if six people were trapped on an island, two adult males and four small children with enough food to last two days if they all ate, but if the men did not eat, there would be enough for the children to eat for a week, it is ok for two men to starve to death if it meant that four children would live long enough to be rescued.Bound by our duties, walk the walk, and practice what you preach, the deontologist’s view of ethics. Contrary to utilitarianism, deontology says that there are some things that we should or should not do regardless of the consequence. Law enforcement officers wear a badge of honor ‘To serve and protect. ’ This motto is definitely one that describes deontology. Another popular slogan we hear is â€Å"Be all you can be. † This duty is demonstrated by our U. S. Army. A bodyguard’s duty is to protect his employer to the extent of endangering his own life.Virtue ethics questions how we should live our lives. A person is judged by his character and not by the actions he may uncommonly choose. Character building takes a lot of work. Character is introduced to us at a very young age by many sources, parents, grand-parents and teachers just to name a few. To me, virtue ethics can be confused as ‘do as I say and not as I do. ’ A person that practices virtue ethics may work for a company that sells automatic machine guns, but teach in his home that guns are bad.

Do you accept extra hours at your work Should your work ethic be based upon the state of the economy - Assignment Example For example,  my job requires me to have open availability on the weekends, however  I don't always work  every Saturday and Sunday   of the month. I believe the acceptable amount of extra hours that an organization should expect from their workers are 26 per month; apart from the Monday to Friday's 40 hour/week. Also, even thought one might work 9 hours a day, we waste around 1 hour and 30 minutes per shift; so in reality we do not work exactly 40 hours per week. YOUR RESPONSE HERE: I agree that in any organization, an employee must be informed of the actual expectations and responsibilities demanded from the job. Like in retail stores, whatever extra hours that need to be rendered should be paid for as overtime pay. These are just to ensure that employees’ rights are protected and employers comply with the regulations imposed by the Labor Department. Person #2 While I may not completely agree with the demand, I don't think that it is completely unfair. I believe that this subject is more of a gray area because of what each individual and each company would consider as being reasonable. If you are expected to work extra hours on  a regular basis* (i.e. 2 or more extra hours per day) at the same salary, I feel that this is definitely unfair. Looking at it from a personal standpoint, I know that I would feel  used and underappreciated.
